What is a home kitchen?
A home kitchen is a small, permitted food business run from a private home — your neighbor's kitchen, legally selling you dinner.
Three legal flavors
- Cottage food operations — shelf-stable goods like baked goods, jams, and granola. Legal in nearly every state.
- Microenterprise home kitchens — full hot meals cooked at home, like a tiny restaurant. Legal in a growing number of states and counties.
- Food freedom laws — a few states let home cooks sell almost anything directly to informed buyers.
State vs. county — know the difference
In some states the rules are set statewide. In others — like California's MEHKO program — counties opt in one by one, so a kitchen can be legal in one county and not the next.
